3. Submitting a DMCA Takedown Notice (Infringement Claim)
To request the removal of legally protected material from RTO Policy India, you must submit a written notification to our Designated Copyright Agent. Under the DMCA, your takedown notice must include substantially the following information in a clear and organized manner. Failure to include all required information may render your notice invalid and delay the processing of your request.
Required Elements for a Valid Notice:
- Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the Copyrighted Work: A detailed description of the copyrighted work that you claim has been infringed. If multiple copyrighted works at a single online site are covered by a single notification, please provide a representative list of such works.
- Identification of the Infringing Material: Clear identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. You must provide specific URLs (web addresses) leading directly to the allegedly infringing content to permit us to locate the material quickly.
- Contact Information: Information reasonably sufficient to permit our administrative team to contact the complaining party, such as a physical address, telephone number, and, if available, an electronic mail (email) address at which the complaining party may be contacted.
- Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Penalty of Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

5. Counter-Notification Procedure
If you believe that your content was removed (or to which access was disabled) by mistake or misidentification, you have the right to file a Counter-Notification. RTO Policy India allows users or content contributors to submit a counter-claim to restore the removed material.
Required Elements for a Valid Counter-Notice:
Your written Counter-Notification must be sent to our Designated Copyright Agent at the email address provided above and must contain substantially the following information:
- Physical or Electronic Signature: Your physical or electronic signature.
- Identification of the Removed Material: Identification of the material that has been removed or to which access has been disabled and the specific URL or location at which the material appeared before it was removed or disabled.
- Good Faith Statement for Restoration: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Personal Contact Information and Consent to Jurisdiction: Your name, physical address, and telephone number. You must also include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, that you consent to jurisdiction in any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receiving a valid Counter-Notification, RTO Policy India will promptly forward a copy to the individual who submitted the original Takedown Notice. We will replace the removed material and cease disabling access to it in not less than 10, nor more than 14, business days following receipt of the Counter-Notice, unless our Designated Agent first receives formal notice from the person who submitted the original notification that such person has filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system or network.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable intellectual property laws, RTO Policy India has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts, access rights, or publishing privileges of users, contributors, or authors who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
7. Modifications to This Policy
